Family Fears Legal Battle Against Uber for USD Student’s Death Might Face Dismissal

SAN DIEGO, CA (May 16, 2024) — The family of Stella Yeh, a University of San Diego student killed on the 805 freeway, fears their lawsuit against Uber may be dismissed. Yeh, 19, died on Mother’s Day 2018 after two cars hit her while she was on the freeway.
The lawsuit claims Yeh was left in a dangerous intersection by an Uber driver after she vomited in the car. Another Uber driver allegedly abandoned her near the freeway onramp, where she was later struck.
Uber has filed a motion to dismiss, arguing there is no clear evidence of what occurred in the 26 minutes between Yeh being dropped off and her being hit. The company also claims it is not liable as the drivers are independent contractors.
A judge previously ruled that Uber has a duty to ensure passenger safety as a “common carrier.” The San Diego Uber lawsuit continues as Yeh’s family seeks justice.
