Federal Wrongful Death Lawsuit Filed Over Toddler’s Fentanyl Overdose

KERN COUNTY, CA (April 19, 2024) — A wrongful death lawsuit has been filed against local sheriff’s deputies in Kern County following the death of a 2-year-old boy. The lawsuit claims the deputies failed to act appropriately during a custody dispute, leading to the toddler’s fatal exposure to fentanyl.
The child, Ezekiel Rivera, was allegedly allowed to remain in the home of his father, Raul Rivera, despite visible evidence of drug possession and a known history of drug abuse. During a custody exchange on June 3, Ezekiel’s mother, Soluna Lora, reportedly warned the deputies about the danger, yet the child was not removed from the home.
Two days later, Ezekiel was found unresponsive and despite emergency efforts, he could not be revived. The coroner confirmed that Ezekiel died from fentanyl toxicity. Raul Rivera, 24, is now facing charges of first-degree murder and child cruelty, with a hearing scheduled for next week.
