New $1.1 Billion Philips CPAP Machine Settlement, See If You’re Eligible
CALIFORNIA (May 28, 2024) —Philips has agreed to a $1.1 billion settlement to resolve personal injury and medical monitoring claims related to its recalled CPAP machines. In 2021, polyester-based polyurethane (PE-PUR) foam used in Philips Respironics ventilators, CPAP, and BiPAP machines was found to degrade, causing serious health issues or death, leading to a mass recall.
CPAP machines are used by people with sleep apnea to keep airways open during sleep. The settlement, announced on April 29, addresses personal injury litigation and the medical monitoring class action resulting from the recall.
The $1.1 billion settlement includes $1.075 billion for personal injury claims and $25 million for medical monitoring. Injuries covered include asthma, chronic obstructive pulmonary disease (COPD), chronic bronchitis, respiratory impairments, lung cancer, and certain blood and ENT cancers.
The new Philips CPAP machine settlement will fund a Medical Advancement Program for research and treatment development related to CPAP machine injuries.
Claim filing details will be available on the official settlement website by June 10, 2024.
Those eligible for the economic loss settlement can still file for personal injury compensation. The deadline for economic loss claims is August 9, 2024.
