SAN JOSE, CA (October 31, 2024) – The family of a 7-year-old boy injured in a June hit-and-run incident has filed a lawsuit against the Kumon Math and Reading Center of Willow Glen, alleging negligence. According to the suit, young Bastian Michel managed to leave the afterschool program unsupervised, resulting in a tragic accident that has left him with severe injuries and a long road to recovery.
Bastian’s mother, Ashley Mompoint-Michel, expressed deep frustration, stating, “What happened to Bastian on June 24 should never have happened to him or any child.”
The family alleges that staff at the Kumon Center were unaware of Bastian’s departure, leading to his being unaccounted for over an hour. During this time, he reportedly walked alone down the street, where he was struck by a vehicle.
The impact of the San Jose hit-and-run caused extensive injuries, including a fractured skull, multiple broken bones, and a ruptured bladder. Bastian’s heart and breathing reportedly stopped at the scene, but an off-duty EMT intervened, performing CPR to save his life.
Bastian’s recovery has been challenging, requiring frequent medical appointments and lifelong medications.
