Inmate Dies After “Less Lethal” Round Used in Prison Fight

NORTHERN CALIFORNIA (June 13, 2024) — An inmate at High Desert State Prison in Northern California died following a confrontation with another inmate and subsequent intervention by prison staff using a “less lethal” round. The incident occurred around 7:20 a.m. on June 5, according to the California Department of Corrections and Rehabilitation.
Jarray Birdon, 38, was involved in a physical altercation during which he was repeatedly struck in the face and head. After failing to comply with verbal orders to cease the fight, correctional officers deployed a 40mm direct impact round and chemical agents to end the altercation. Birdon sustained injuries consistent with being hit by the less lethal round.
Following the incident, Birdon was transported to an external hospital, where he was pronounced dead at 12:41 p.m. on June 7. The other inmate involved suffered a fractured right hand, but no staff members were injured during the incident.
