Uber Eats Faces Racketeering Lawsuit Over Imposter Restaurants in Nevada

(April 27, 2024) — Uber Eats is embroiled in a class action lawsuit involving several Nevada-based restaurants.
These establishments have accused the food delivery service and its drivers of supporting fraudulent operations that masquerade under legitimate business names. The lawsuit, filed in Clark County District Court, includes allegations of racketeering, fraud, and negligence.
Restaurants such as Esther’s Kitchen, Babystacks Cafe, Manizza’s Pizza, and Gaetano’s Ristorante claim they have suffered financial losses due to “imposter” entities that sold food under their names, facilitated by Uber Eats. According to the legal complaint, Uber Eats took a 30% commission from these transactions without verifying the authenticity of the listed kitchens.
In response to these allegations, Uber Eats has halted new applications for virtual kitchens in the Las Vegas area and now demands business licenses and physical addresses from new sign-ups.
The plaintiffs allege that at least 1,000 local restaurants were affected, seeking damages that exceed $150,000 collectively.
The suit also accuses certain Uber Eats drivers of knowingly delivering food from these imposters, further implicating the company in fraudulent practices designed to exploit established restaurant brands for profit. The Uber Eats racketeering lawsuit marks a significant challenge to Uber Eats, questioning the integrity and operational procedures of its network.
